ARTICLE 1 : ACCEPTANCE OF THE GENERAL CONDITIONS OF USE

The User is presumed to know and accept, without reservation, all of the T & Cs simply because of his connection to jmpparis.fr (the Site), regardless of the digital reception terminals used.

The T & Cs apply concomitantly to the privacy policy.

The User is invited not to connect to the Site if he does not accept all or part of the document referred to above.

ARTICLE 2 : ACCESS TO SERVICES / AVAILABILITY OF THE SITE

The Publisher undertakes to make its best efforts to ensure that access to and operation of the Site is guaranteed 24 hours a day (24 hours a day) and 7 days a week (7 days a week) without interruption.

However, the Publisher cannot be held liable in the event of temporary unavailability of the Site (i) in the event of maintenance of the Site on which it is hosted, (ii) in the event of the occurrence of events outside its will and its control, or (iii) due to force majeure.

On the occasion of any use of the various Services to which the JMP CONSULTING & DEVELOPMENT site provides access, any User undertakes both with regard to the Publisher and other registered Users and in general to any third party, to:

Provide accurate data:

Not to usurp, in whole or in part, the identity, title or quality of a third party;

Notify the Publisher of all logical and technical malfunctions that it may notice and any anomalies that it may discover.

3.2. Commitment to Comments posted by the user

The information published on the site is reserved:

i) Consulting information using the Publisher’s automated data processing system;

ii) For uses strictly reserved for the private and non-commercial use of the User and not intended for collective use, free or paid.

The User declares and acknowledges that all information, data, texts, software, music, sounds, photographs, images, videos, messages or any other content that he transmits are under his full and sole responsibility.

The User undertakes both with regard to the Publisher, as well as to other Users and in general to any third party, to unconditionally comply with all applicable legislation, and more particularly:

Intellectual property law applicable to multimedia creations, software, texts, databases, articles, photos, videos, trademarks, databases, images of any kind;

The right to the image of models appearing in photographs;

The rights of photographers and agencies in these photographs;

The Data Protection Act relating to the protection of individuals with regard to the processing of personal data;

The law of the press;

The legal protection device against computer fraud.

Consequently, any User is prohibited both with regard to the Publisher, other registered Users and in general any third party:

Disseminate statements that are defamatory, abusive, harassing or threatening anyone, or in violation of the rights of others;

To defend crimes against humanity, to incite racial hatred or pedophilia;

Create a false identity or usurp the identity of a third party;

To transmit viruses, a Trojan horse, logic bombs or any other harmful or destructive program;

Obstruct the Services associated with the Public account;

To take back all or part of the content of pre-existing works without the authorization of the holders of the rights to these works;

To reproduce and / or use the brand, company name, logo or any distinctive sign and in general any data of any kind whatsoever, editorial, graphic or other from the Publisher, another User or ‘a third ;

To proceed or even attempt an intrusion into the Site and / or the Applications or the administration information system of the Site and / or the Applications or to modify, totally or partially, the elements contained therein.

The User undertakes, where applicable, to indemnify the Publisher for any damage directly or indirectly related to the non-compliance with these guarantees.

Any User who acts in fraud of the T & Cs is liable to civil and / or criminal proceedings.

3.3. Duty of vigilance

Any User acknowledges being informed that a posteriori moderation on his Comments is implemented to control, delete or modify the content published by the Users which would appear contrary to the laws and regulations in force, or which would have been indicated as such by the judicial authority.

ARTICLE 4 : RESPONSIBILITY OF THE PUBLISHER

JMP CONSULTING & DEVELOPMENT, Publisher of the Site, acts as a host for the Comments posted by Internet users on the Site.

In accordance with the provisions of the law on Confidence in the Digital Economy of June 21, 2004, the responsibility of the Publisher concerning the Services offered is that of a content host, these Services, allowing Users to post comments for each article published by the editorial staff of JMP CONSULTING & DEVELOPMENT (hereinafter and hereinafter referred to as the “Comments”). The Comments do not fall under the editorial activity of the Publisher, which only makes this Service available to Users and stores its content on its own Site.

Thus, the Comments published can not be considered as reflecting the opinions of the Editor and the latter cannot therefore be held liable for the Comments posted by Users if he has not actually been aware of the Comment before its uploaded or if, as soon as he became aware of it, he acted promptly to remove this message.

ARTICLE 5 : HYPERTEXT LINKS AND PARTNER SITES

The establishment of a hyperlink to the Site requires prior authorization from the Publisher. Such links do not engage the responsibility of the Publisher.

In addition, the Publisher may provide links to other websites or other sources of information managed by third party sites. Since the Publisher is unable to control the content of these sites, the existence of such links cannot engage the Publisher’s responsibility for the content, advertising, products or services available on these external sites, which the User recognizes and accepts.

ARTICLE 6 : INTELLECTUAL PROPERTY

6.1. Site content

JMP CONSULTING & DEVELOPMENT owns the domain name: https://www.jmpparis.fr

The Site and the elements that compose it are the exclusive property of JMP CONSULTING & DEVELOPMENT, and of its respective owner, the only one authorized to use the intellectual property rights and personality rights relating thereto, in particular copyright and rights to the image.

All the elements of the Site edited by JMP CONSULTING & DEVELOPMENT (in particular the structure, all texts, photos, videos, logos, and other elements reproduced) are reserved and protected by intellectual property rights.

The use of all or part of the Site and the Applications, in particular by downloading, reproduction, transmission, representation or distribution, for purposes other than for personal and private use for non-commercial purposes by the Internet user, is strictly not allowed. Violation of these provisions subjects its author to the penalties provided for, in particular, for infringement of copyright and trademark law.

6.2. User comments

The User declares and guarantees:

i) To be the owner or holder of the necessary rights and / or authorizations relating to copyright, personality rights or other intellectual and / or industrial property rights possibly attached to his Commentary

ii) Benefit from the prior written authorization of each individual identifiable in their Commentary to use their name and / or image and / their voice for the purposes of their dissemination on the Services.

In return for using the Services, the User transfers to the Publisher, free of charge, their rights to their Comments for the following uses:

i) Reproduction, in whole or in part, of its Comments, their integration and communication on the Sites and Applications, accompanied or not by other Content as well as their communication to the public by any communication medium known or unknown to date

ii) Adaptation for the needs of the rights referred to above.

This assignment is issued free of charge for the whole world and for the entire duration of legal protection.

ARTICLE 7 : SPECIAL CONDITIONS OF USE : NEWSLETTER

The Publisher offers Users the option of subscribing free of charge to Newsletters from JMP CONSULTING & DEVELOPMENT (hereinafter the “Newsletters”), in compliance with the provisions of the “Data Protection Act” and the GDPR. This Service allows Users to receive news and the latest news published on the Site.

The User can unsubscribe from these Newsletters at any time by using the unsubscribe link that the User will find at the bottom of each newsletter sent.

ARTICLE 8 : APPLICABLE LAW AND COMPETENT COURT The non-compliance by the User, whatever his location, with any of the provisions of the T & Cs and more generally any difficulty relating to its execution, interpretation or validity, are subject to French law and to the French courts.
